BANYUWANGI – The case that ensnare the Village Head of Wonosobo, Srono . District, Agus Tarmidi enters a new chapter. The non-active village head is undergoing the District Court trial process (PN) Banyuwangi, Thursday (29/3/2018).
The agenda for the trial chaired by the Chairman of the Panel of Judges I Gusti Ayu Akhiryani was to hear the reading of the public prosecutor's indictment.
In his claim, Public Prosecutor (JPU) I Ketut Gde Dame Negara said, the defendant Agus Tarmidi on Saturday (24/2) around 12.00 by Cafe Java River Side, Dusun Krajan Sempu Village/District, trying to persuade Syamsiyati to give something.
Originally, the defendant once asked the witness Endri Pujianto for some money, about two days after the OTT was done (Operation Catch Hand) alleged violation of Complete Systematic Land Registration (PTSL) Tegalarum Village by the Team from the Banyuwangi Police which happened on 27 February 2017.
At that time, the defendant came and met Endri Pujianto, Achmad Turmudzi, Praise Bambang, and Maryoedi at the Tegalarum Village office, Sempu Kecamatan District, accompanied by Ipung Poniyahadi.
The arrival of the defendant to ask for money in the amount of Rp 40 million on the pretext of solving cases at the Banyuwangi Police Police level. Based on that, then Endri Pujianto, Achmad Turmudzi, Praise Bambang, and Maryoedi complied with the defendant's request by way of a portion. Each one, the village side of Rp 15 million, district Rp 15 million, and Pokmas Rp 10 million.
Then, at noon on the same day, the defendant returned to Endri Pujianto, Achmad Turmudzi, Praise Bambang, and Maryoedi to take money in the amount of Rp 40 the million. After the money was handed over to the defendant, the handling process of PTSL Tegalarum's alleged pungli case is still ongoing. Even, Endri Pujianto and Muhammad Basuni were named suspects by the police.
Because the handling process of PTSL Tegalarum's alleged pungli case is still ongoing, then the defendant contacted Achmad Turmudzi by telephone saying that he should immediately prepare Rp 50 million to close the case at the Banyuwangi State Attorney. And, if there is no money then the case regarding alleged PTSL extortion will be “rolling.
With this request, then Achmad Turmudzi conveyed it to Endri Pujianto, Praise Bambang, and Maryoedi. Because he believed what the defendant said, then they agreed and agreed to bear the demand for money from the defendant by way of a refund. Namely the village Rp 17 million, the sub-district Rp 17 million, and Pokmas Rp 17 million.
After that, the defendant was contacted by telephone by Achmad Tumiudzi to come directly to Tegalarum Village, in order to convey the need for requests for money directly to Endri Pujianto, Praise Bambang, and Maryoedi.
“After the accused came, then the defendant also explained that he had spent Rp 10 million of his personal money for the Banyuwangi District Attorney. even though, this was not done by the defendant at all.” said I Ketut Gede Dame Negara.
So that, on this explanation, on Saturday date 24 February 2018 around 12.00 of Cafe lava River side, Dusun Krajan, Sempu Village/District, Endri Pujianto handed over Rp 10 million to the defendant from a request of Rp 50 million witnessed by Muhammad Basuni, as a member of the PTSL Pokmas, Wiratno alias Pak Wit as Chair of Pokmas, Maryoedi, one of the staff from the Sempu District Head, Achmad Turmudzi as Kades Tegalarum, and Bambang Pamuji as Secretary of Tegalarum.
“Meanwhile, the drawback is Rp 40 million, the defendant asked Endri Pujianto and his friends to hand them over to the defendant on Monday 26 February 2018,” clear.
For the actions of the accused, The public prosecutor applied the primary charges under Article 378 Criminal Code on Fraud. The public prosecutor also applied for alternative charges, that is, by article 368 Criminal Code on Extortion.
After the reading of the indictment was read out, the defendant through his Legal Counsel, Eko Sutrisno, did not submit an exception or objection to the indictment. The trial was adjourned, and resumed on Thursday (5/4) with the agenda of hearing witness statements that will be presented by the prosecutor.
